1. Acceptance of Terms
By accessing or using the Cultural Calendar platform (“Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Seminal One Pty Ltd (“Company”, “we”, “us”, or “our”).
2. Description of Service
The Cultural Calendar is a platform that provides curated cultural event data, calendar feeds, and team collaboration tools for organisations tracking cultural events globally. The Service includes event browsing, personalised calendar subscriptions, iCal feed exports, and team management features.
3. Account Registration
To access certain features you must register for an account. You agree to provide accurate and complete information during registration. The Service uses passwordless authentication — a magic link will be sent to your registered email address each time you sign in. You are responsible for maintaining the security of your email account. You must notify us immediately of any unauthorised use of your account.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Transmit any harmful, offensive, or unlawful content
- Scrape, crawl, or systematically extract data without prior written consent
- Attempt to gain unauthorised access to any part of the Service or its related systems
- Impersonate any person or entity
- Interfere with or disrupt the integrity or performance of the Service
5. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are the exclusive property of Seminal One Pty Ltd or its licensors and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process personal information in accordance with the Australian Privacy Act 1988 and the Australian Privacy Principles. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this document and, where appropriate, by sending an email notification. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
